These terms and conditions outline the rules and regulations of working with ETARBIYAT (PRIVATE) LIMITED. By signing a contract with ETARBIYAT (PRIVATE) LIMITED, we assume you accept these terms and conditions. Do not continue to work with ETARBIYAT (PRIVATE) LIMITED if you do not agree to take all of the terms and conditions stated on this page.

The following terminology applies to these Terms and Conditions:

• "Client", "You" and "Your" refers to you
• "The Company", "Ourselves", "We", "Our" and "Us", refers to ETARBIYAT (PRIVATE) LIMITED
• "Party", "Parties", refers to both you and ETARBIYAT (PRIVATE) LIMITED

Quality

Our content furnished under these terms and conditions is provided on an "as is" basis, without any warranties or representations expressed, implied, or statutory; including, without limitation, warranties of quality, performance, non-infringement, merchantability, or fitness for a particular purpose. Nor are there any warranties created by a course of dealing, course of performance, or trade usage. We do not warrant that the operation of our product will be continual, uninterrupted, or error free.

Nonetheless, we will ensure that your project and application will stay up to date and error free.

Confidentiality

During the course of this agreement, it is likely that each party will come into contact with confidential information crucial to the operation of each parties business. Such confidential information may include, without limitation: (i) business and financial information, (ii) business methods and practices, (iii) technology and technological strategies, (iv) marketing strategies and (v) other such information each Party deems as “Confidential Information”. By these terms, each party agrees to keep in strict confidence all non-public information so long as it remains non-public

Payment

Regarding the payment, following are the terms and conditions;

• a. Once you have signed the contract, your project shall not begin unless 50 (fifty) percent of the total decided amount is paid upfront at the time of signing the contract. We will not be responsible for any delay or inconveniences that may be caused by the late payment.
• b. Remaining amount can be divided in terms of the following:
  1. i. First Term: You can divide the remaining 50 (fifty) percent into two parts and pay the half at the completing of a major milestone and remaining at the completion of the project.
  2. ii. Second Term: You can pay the rest of the 50 (fifty) percent at the completion of the project. This term is purely subjected to the “nature” of the project.
• c. If you fail to pay the remaining installments on time, any delay caused due to that, we shall not be held responsible in any way possible.

Refund / Cancellation

Regarding the refund / cancellation of the payment, following are the terms and conditions;

• a. Initially paid installment of 50 (fifty) percent is non-refundable if the project is already started and team / developer has been assigned to it. Initial amount shall only be returned in the case the project was “called off” or canceled within the 1st (first) week of being started.
• b. Other installment / amount paid based on the conditions decided under the “Payment” clause “b”, are subjected to refund based on the progress of the project.
